The Power of Persuasion in Mediation:
Trampling on Party Self-Determination?
Mediators are neutral, impartial insurers of self-determination and control of the process. Mediators under the predictors and tools of influence can help parties achieve clarity, regain power, and break negotiation impasses. This session will start with the audience’s perspective of self-determination in Mediator Standard of Conduct 1: Self-determination and the sharing of examples of their exceptional opening statements “before” the meeting. Then, they will shift to explore the six (6) principles of persuasion, or ways to get people to say “yes”, outlined by Robert Caldini in: Influence: The Psychology of Persuasion, Harper Collins, 2007, (Reciprocation, Social Proof, Commitment and Consistency, Liking, Authority and Scarcity) to problem solving in mediation and the six categories of negotiation power outlined by Roger Fisher in , “Negotiating Power: Getting and Using Influence,” in J. William Breslin and Jeffrey Z. Rubin, eds., Negotiation Theory and Practice (Cambridge: Program on Negotiation at Harvard Law School, 1991), pp. 127-140. In all of this discussion, focus will be on the right words at the right time.
Presenter: Joyce A. G. Mitchell, Esq.
Joyce Mitchell is a Distinguished Fellow of the International Academy of Mediators (IAM) and President of Joyce A. Mitchell and Associates. She mediates and arbitrates complex employment, business and securities cases nationwide. She is a certified mediator in the states of Virginia and North Carolina. She is on the mediator rosters of the EEOC, and several other Federal agencies. Joyce arbitrates for the Financial Industry Regulatory Authority (FINRA) and the American Arbitration Association (AAA). She was a co-trainer of the MD State Bar Association’s 40 hr. basic mediation training for 5 years and has provided training for basic mediation and early neutral evaluation twice each to the USDA. Joyce is a former adjunct professor at the Columbus School of Law, Catholic Univ. in Washington, DC where she taught ADR Techniques. She is a past chair of the MD State Bar Association ADR Section and a past co-chair of the Bar Association of Montgomery County MD ADR Section. In October 2017, Joyce was a co-panelist at the ABA Dispute Resolution Section’s program in Washington, DC on Diversity in ADR. In April 2018, she will speak at the Winkler Institute of Dispute Resolution, Osgoode Hall Law School, Toronto, ON, April 23, 2018 on “The Evolution of Mediation: Fitting the Forum to the Fight.”
