A Workshop Mediating Financial Issues

Applying facilitative mediation skills and techniques to high asset individuals or couples dealing with financial and property issues present a bit of a conundrum, especially for those individuals residing, or owning a business or property in equitable distribution states.  This workshop is intended to offer guidance, what the mediator needs to know, ask, and how to frame financial and property distribution issues.  Initially this master class was directed to mediating high asset divorce cases, the principles involved are the same for a mediation involving any level of assets.  The key word is "Assets."  The parties should own a fair amount of investments, business, or real estate assets.  They might be the beneficiaries of a trust fund, hold patents, or are high income earners.     

Money means so many different things to people.  Yet, what is this “thing” we call money.  How can the mediator even fain to mediate without a clear understanding of how money works, what it can do, and how to determine what it means to each individual in the room.  The world has truly changed over the past ten to fifteen years.  the song no longer goes:  "Money, Money, Money, Money.  A Mark, a Yen, a Buck or a pound...."  These days the refrain goes more like: "A Euro, a Yuan, a Buck or a Bitcoin."  Do you speak the language?

This is an advanced master class for mediators.  You will have taken 40-hours of basic mediation training.  An advanced 20-hours training in property mediation would be helpful although not required for this workshop.  This workshop is recommended for any mediator interested in going to the next level:  Mediating higher asset cases.  

Topics will include, but are not limited to:

  • 1.      Money as fungible, a store of value:  Salt, spices, and gold
  • 2.      “Transactional” cash and electronic currencies: Bitcoin and blockchain-hybrid
  • 3.      Asset classes:  Tangible and Intangible
  • 4.      Personalities types, education, gender and culture:  How each relates to their money
  • 5.      Determining financial values associated with Tangible & Intangible assets
  • 6.      Out-of-state, community property and international asset holdings
  • 7.      Considering family owned business assets and values
  • 8.      Understanding Form 1040, Schedules E, D, and C
  • 9.      Investment fees, costs to carry, negative interest rates and the inheritance
  • 10.    Insurance and derivative financial assets
  • 11.    Understanding the estate plan and situational trusts: Special Needs
  • 12.    Understanding pensions under ERISA, OPM, and the Military: QDROs, Court Orders, and the Bangs              Distribution

Each 2-hour workshop will run on two consecutive Saturday mornings, from 10:00 until noon, November 5 & 12.  The workshops will be held in Rockville, 1 Preserve Parkway, Suite 120 in the main conference room.  Street parking is free; guest parking for a fee is located adjacent to the building.

Class size is limited to 8 participants on a first come first serve basis.  Coffee, hot tea, cold bottled water and soft drinks as well as candy are made available at no charge.

Registration and payment in full must be received at least two-weeks prior to the start of the first two-hour workshop. Upon receipt of your e-mail statement of intent to participate, including contact information you will be registered.  Once payment is received you will be sent via e-mail various links to financial calculator websites and proprietary spreadsheet templates.

Cost for the two sessions is $150.00 for MCDR members, $200.00 for non-members.  Non-members will also receive with their paid registration a one-year membership in MCDR.
