What is Divorce Mediation? Divorce mediation is a process where a divorcing couple works with a trained neutral third party, the mediator, who can help them work out issues that need resolving, consider options and work out an agreement. Mediation minimizes conflict, helps to foster increased cooperation between divorcing couples, and leads to agreements that are arrived at by mutual consent, as opposed to agreements that are court-imposed.
A mediator helps by keeping the lines of communication open and by assisting the couple with their decision making processes. Mediated agreements can include child access schedules, parenting issues, decision making on behalf of children, financial matters, such as child support and alimony, tax issues and property division, which can include real property, retirement plans and personal property. The benefits of mediation include arriving at practical solutions that are tailored to each couple’s circumstances, minimizing the cost of divorce, and maintaining control of the outcome, which is typically not the case with a court-imposed decision.
